Terms of Service
1. Who we are
The Plug ("The Plug", "we", "us") is operated by Nicolas Dufriche (professional name Nick Green), a sole trader based in the United Kingdom. You can contact us at ngreen@nextplaymusic.io. Postal address: 23 Waghorn Street, London, SE15 4LA, United Kingdom.
Next Play Music Group Ltd is a separate company. It does not operate The Plug and is not a party to these Terms.
These Terms, our Privacy Policy and, if you buy a paid plan, our Subscription Terms together form the agreement between you and us.
2. The Plug is in BETA
The Plug is currently offered as a BETA service. We are still developing it, so features may change, be added or be removed, and the service may sometimes be unavailable, slow or contain errors. We will make reasonable efforts to keep The Plug available and to fix problems, but we do not promise that it will be uninterrupted or error-free.
3. Who can use The Plug
- You must be 18 or older to create an account or use The Plug. We ask you to confirm your age when you sign up.
- You must give accurate information and keep it up to date.
- You are responsible for keeping access to your email account and sign-in details secure, and for activity on your account.
- You may not create an account for someone else or use another person's account.
4. Creator and A&R accounts
There are two kinds of account:
- Creator accounts are for artists, producers, songwriters and other music creators who want to submit music to opportunities.
- A&R (Industry) accounts are for music professionals who post opportunities and review submissions. Industry accounts are reviewed manually and only get access once we approve them. We may refuse or withdraw approval.
5. Opportunities, submissions, feedback and messages
- Opportunities. A&Rs can post opportunities ("briefs") describing the music they are looking for. A&Rs are responsible for the accuracy of their opportunities. Opportunities may close, expire, be edited or be removed.
- Submissions. Creators can submit tracks to opportunities, within the submission allowance of their plan. A submission is shared with the A&R behind the opportunity. Submissions are private unless you choose to make one public.
- Listening and outcomes. Every valid submission made in accordance with the relevant brief and these Terms will be listened to. The professional reviewing it decides, in their professional discretion, whether to reject it, keep an interest in it, mark it as Plugged, or provide feedback. Detailed feedback is not systematic. Where the service expressly offers a further submission after feedback, that option is subject to the conditions shown with it.
- Valid submissions. A submission is valid only if it is complete, playable, relevant to a brief that accepts it, made within your allowance, and complies with these Terms and the brief. We may reject or remove invalid, duplicate, abusive or rights-infringing submissions without listening to them.
- Messages. Connected users can message each other on The Plug. You are responsible for what you send.
- Public profiles. Creator profiles, and some activity such as badges and public submissions, can be seen by anyone, including people without an account. See our Privacy Policy.
6. Your music and your rights
When you submit music, you confirm that:
- you own, or control, all the rights needed to submit the music and allow it to be used as described in these Terms — including the rights in the composition, the recording, and any lyrics, artwork and performances it contains;
- you have the permission of every co-writer, producer, performer or other rights holder whose permission is needed;
- the publishing status, co-writers and other rights information you provide are accurate, and previously released music is submitted only where the brief allows it;
- your music does not contain uncleared samples or any other third-party copyrighted material you do not have the right to use. Royalty-free samples, sounds you created yourself and legally cleared samples are allowed;
- your submission is not a fully AI-generated song and does not use an AI-generated or cloned singing voice;
- your music and its information do not infringe anyone's rights or break any law.
You are responsible for your submissions. If we receive a credible complaint that a submission infringes someone's rights, we may remove it and take action on your account.
7. You keep ownership of your music
You keep all ownership of your music. Nothing in these Terms transfers to us or to any A&R any copyright, publishing rights, master rights or other rights in your music.
So that we can run The Plug, you give us a limited, non-exclusive, royalty-free licence to store, host, copy, stream and display your music, its artwork and its information, only as needed to operate The Plug: to deliver your submissions to authorised reviewers, to show content you choose to make public, and to keep the service working and secure. We do not use your music to train generative AI models. This licence ends when your music is deleted from The Plug, except for copies we must keep by law or that remain temporarily in provider backups.
8. What A&Rs may do with submissions
A&Rs may listen to and evaluate submissions only to consider them for the opportunity they were submitted to. A&Rs may not copy, distribute, publish, release, sync, license or otherwise commercially exploit any submission, or share it outside their organisation, unless they have a separate agreement with the Creator that allows it.
Any deal, licence or collaboration between a Creator and an A&R is a matter between them. The Plug is not a party to it unless we expressly agree in writing.
9. No guaranteed results
The listening commitment in section 5 does not guarantee detailed feedback, selection, a placement, recording contract, publishing deal, sync, income or any other career result. “Plugged” records professional interest on The Plug; it is not a placement or a contract. We do not guarantee the number or quality of opportunities available at any time.
A publishing agreement with Next Play Music Group Ltd, including any rights, percentages or advance, exists only if you separately sign a written agreement with that company. Nothing on The Plug creates one automatically.
10. Acceptable use
You must not:
- upload or share content you do not have the rights to, or that is unlawful, abusive, harassing, hateful, sexually explicit or misleading;
- impersonate anyone, misrepresent your identity, role or affiliation, or post fake opportunities;
- use The Plug to send spam or unsolicited promotions, or to collect other users' personal data;
- try to get around submission allowances, payments, access controls or other limits;
- interfere with, overload, scrape, reverse-engineer or attack The Plug or its users;
- use The Plug in a way that breaks any law or these Terms.
11. Moderation, suspension and ending your account
We may review, hide or remove content, close opportunities, and limit, suspend or close accounts if we reasonably believe someone has broken these Terms, created a risk for other users or for us, or where the law requires it. Where appropriate, we will tell you why.
You can stop using The Plug at any time. To close your account and have your data deleted, contact us at ngreen@nextplaymusic.io. If you have a paid plan, please also cancel it as described in the Subscription Terms.
12. Paid plans
Creators can use a free submission and can buy a paid monthly plan for more submissions. Paid plans are covered by our Subscription Terms, including automatic renewal, cancellation and refunds.
Withdrawing an unreviewed direct pitch removes it from consideration but does not restore the submission allowance used to send it. A submission cannot be withdrawn after a reviewer has acted on it.
13. Third-party services
The Plug relies on third-party services, such as Stripe for payments, and may link to services such as Spotify or SoundCloud. Their own terms apply when you use them, and we are not responsible for them.
14. Our responsibility to you
- Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited or excluded by law. Nothing in these Terms affects your statutory rights as a consumer.
- We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these Terms or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable.
- If you use The Plug for business purposes, we are not liable for loss of profit, loss of business, business interruption or loss of business opportunity.
- We are not responsible for content posted by users, for the decisions of A&Rs, or for agreements between users.
- Where the law allows, and except for the liability we cannot limit described above, our total liability to you is limited to the greater of £100 or the amount you paid us in the 12 months before the claim.
15. Changes to these Terms
We may update these Terms, for example when we change The Plug or when the law changes. When we make an update that requires your agreement, we will ask you to accept the new version before you continue using your account.
16. Governing law
These Terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer living in Scotland or Northern Ireland, you may also bring proceedings in your local courts. This does not take away any mandatory consumer protection that applies to you under the law of the country where you live.
